Is it possible in the case of a bidding consortium to provide more than the three references specified under items III.2.3. nos 1.1 to 1.8, or may a bidding consortium really provide only a maximum of three references altogether for each number in the tender application?

The maximum number of three references each must be observed. The bidder should choose the references most appropriate to the comparable project work as defined in the invitation to tender.

Regarding II.1.) of the tender publication, at what point must a contract performance guarantee/warranty against defects be furnished? Is written confirmation from a bank or a credit insurer that such a guarantee will be issued already required when the tender documents are submitted?

The contract performance guarantee must be furnished by the future contractor only upon the contract having been awarded. The guarantee can then be replaced by a warranty against defects following acceptance of the project work and the final invoice. The details are set out in the general terms and conditions of the contract, which shall be a constituent element of the bidding documents sent out to the selected bidders. It is not necessary to include a written confirmation from a bank or credit insurer with your bid.

Regarding item III.1.4.) of the tender publication, must an appropriate professional indemnity insurance policy have already been taken out when the tender documents are submitted or is it sufficient to obtain such cover once the contract has been awarded?

The professional indemnity cover required in the tender publication must be provided by the future contractor after the contract has been awarded. Item IV.1.1.) of the tender publication
Regarding weighting, the fee is set at 40%. Does this mean that the invitation to tender already requires the fee to be specified?

Only such proofs and documents as required under item III.2) of the tender publication as evidence of the bidder’s suitability should be submitted with the bid.
Information about the weighting of evaluation criteria applies to the evaluation of bids. It is not necessary to state a fee during the initial qualification stage. The selected bidders will only be required to stipulate the fees in question when called upon to submit their bid and upon receipt of the tender documents, which contain all further details.
